California Passes Delete Act

On September 13, 2023, the California Assembly voted 52 -14 (with 12 abstaining) to pass the California's Delete Act (CA SB 362), requiring the California Privacy Protection Agency (CPPA) to create a portal by January 1, 2026 for residents to request deletion of personal data that has been collected by the 486 registered data brokers in the state through a single click. The bill further allows authorized agents to request deletion on a consumer’s behalf. Registered data brokers would need to begin applying deletion requests as of August 1, 2026. Brokers will have to perform the process at least once every 45 days, and continue to delete a consumer’s designated information on a go-forward basis unless the consumer updates their request. Unverified requests would need to be treated as ‘opt-outs’ rather than as deletions. Our expectation is that this will reduce the amount of data that can be leveraged in third party models, and lead to a reduction in rentable names. The bill next heads to the Governor’s desk for signature.
